Trick or Treat and Birthday Wishes




Today is the beginning of the 21st year for one of the most notorious twinks in the history of twinkdom. Lets all say Happy birthday to him and best wishes for a better year.
Happy birthday Sean. Scorpios rule!

BB's latest post seems to be a Halloween trick of sorts as I have received no new information on Joe and Harlow and all seems to be well. A trial seems to be eminent.







We also want to Say hello to a new blogger, Jim has a new blog "Silence of the Chinchillas" is a cute play on words and might be of interest to the all of the Harlow haters out there in blogland.
And I just got the lowdown from Virginia Beach that there were no Federal warrants issued for Joe and Harlow. Because if there were warrants extradition would not have been a issue now would it. I wonder where that trick started. Oh and by the way the Asst. DA in Virginia swore to that in a Court of Law. Guess that kills that theory.

And last but not least I still have not seen the email that I sent to the "unmentioned one" yet posted on his Technicolor trash page I guess he is still thinking of a lie to post about what it said.
I am starting to get impatient, I want to know what I wrote.

Deceptions






Why would someone post some of the horrid things that I have seen posted on some of the blogs? This is all in regards to the senseless death of a human being? Why would some revel in the misfortune of those who are accused of said crime? It really makes we wonder what the world is coming to. The police knew that the victim was a not a well-liked person so I guess to make the charges stick they had to vilify those who are accused of killing him.

When I first read about the murder of Bryan Kocis almost 10 months ago I thought to myself, oh my god this is horrible. I thought some deranged fan of Sean Lockhart might have done this. My next thought was that Sean was in danger from this crazy obsessed fan. Then I started to read all of the supposed theories of the other bloggers and thought that some were plausible and some were not. As we moved forward and more information surfaced and we had to dig through it all to get at the truth that original thought I had was changed.

Now I know that Bryan Kocis was no angel but the way he was killed showed that someone hated him with a passion that caused me to take pause. When you think of the way he was killed he would have died almost instantly yet someone was filled with so much rage that they stabbed his dead body 28 additional times. To me that shows that who ever killed him was not satisfied with the fact that he was dead and felt that he did not suffer enough. The fact that he was stabbed 28 more times alone speaks to rage of the killer. The way he was killed made me think of the O.J. Simpson case. The only thing that still has me puzzled was the lack of defensive wounds on the victim. Was Bryan incapacitated when he was killed? Did his killer surprise him? Was there more than one person involved?

From the arrest affidavit we have probable cause to believe that those who are accused of this might have done this. But the reason for them doing this still leaves me perplexed. They kill him to work with one of his models? Now I don’t know about any of you out there but Abraham Lincoln freed the slaves and you can not own another human being in the United States of America. So in effect Bryan Kocis really had no hold on Sean Lockhart. So what was there to stop Sean from working with anyone he wanted to work with? Why would Joe and Harlow kill a man they did not even know to work with Sean Lockhart? If you were Sean would you want to work with someone who had just killed someone in cold blood? So that just makes no sense to me all around.



The other thing that I find interesting is that Bryan sued Sean for breach of contract and cyber-squatting because he used his stage name "Brent Corrigan" on an Internet web-site. Now this brings to mind two things that I find interesting.



1: Bryan filed for a trademark on the name Brent Corrigan and the images of that persona. What purpose would it serve Bryan to own that name? It is not like he was going to use it for himself as a stage name or for another model. The name itself was attached to a living person and would be virtually useless too Bryan as Sean Lockhart was the person that the name was attached to. The fact that Sean filmed the Velvet Mafia under a different name should have shown Bryan that.



2: The contract that Sean broke with Cobra Video was non-binding as you can not require someone to perform a sex act on film, video or in the privacy of your own home. Because forced sex is considered rape and payment for such is prostitution and that is illegal.



So what was the civil suit all about? The fact that Cobra Video was in fact two different entities, one from Pennsylvania formed in late 2001 and the other from Delaware formed in 2005 and from what I have been able to decipher they were independent of each other. To me it looks like Bryan was hedging his bets when he sued Sean and Grant with the newly formed in 2005 Delaware entity of Cobra Video. The funny thing is the Pennsylvania version of Cobra Video was the one that held the trademark on the name "Brent Corrigan" and they also had the broken contract as well. So the lawsuit was suspect at best. Also during this period Bryan's earlier conviction was changed to corruption of a minor. This was so he was not required to register as a sex offender.



The other thing that is disturbing is the fact that Bryan was going to buy out Lee Bergeron's Share of LSG Media of which Lee was the principle shareholder, thus making Bryan the principle in a company that he was suing. Now from what I have gathered Lee was not mentioned in the original civil suit. Bryan was going after Sean and Grant on all fronts. Sean had threatened to drop the name Brent Corrigan so Bryan would have no hold on him. So he went after the company that Sean was part owner of. What I also find interesting is that there has never been another case that I know of where a model was sued by a porn producer. I guess Bryan just did not want to loose.

What was Bryan’s fascination with a model that wanted nothing to do with him? Was Bryan in love with Sean or did he just want to destroy him? From where I sit it looks like destruction was his goal. Sean had too much information against Bryan for him to just let him go. Bryan was aware of Sean’s age fraud from early on and he apparently did not care. He was aware of the forged age documents and he had Robert Wagner witness them making him a party to that fraud.

With the bogus lawsuit he filed he made his attorney possibly a party to that fraud when he lied and sued LSG Media with a company that did not even exist when the contract was broken or the age fraud occurred. What was the purpose of all of this? Al Flora, his attorney when he was charged with having sex and filming it with an underage boy was also a possible party to his fraud when he claimed that the model he was filming was for his Video Company, which at the time did not yet exist. And he did not yet have his valid ID on record. And Bryan’s claim that the boy lied about his age would have made any another video producer more diligent in his 2257 record keeping with regards to the types of boys he filmed. From what I have gathered companies do not film they’re models until they have proof on file for them. And from statements from people, who knew Bryan, they claimed that Cobra was more of a hobby than a business for him. That would explain the hundreds of videotapes seized when he was arrested. Bryan liked to film boys having sex as a hobby and he did this before he had a company to produce these videos.

Why all the fraud from this one man who the police claim was a businessman. Some business he ran, he filed for bankruptcy in 2002 because of a failed cellular phone business venture with his sister. Who he sued because she wanted nothing to do with him after he was arrested for molesting that fifteen year-old boy and he plead guilty. Then he starts a porn venture when he was for all intensive purposes broke. He files for a Limited liability company in Pennsylvania and says that he is the sole proprietor of it.



So in effect he started his company and said he was the sole owner is suspicious in the fact that it was done to cover the lie that he told his attorney; his claim that he was filming those boys for his video company. From what I have gathered the business he ran was illegal in the state of Pennsylvania. That is correct it is against the law to produce pornography in the state of Pennsylvania. Yet Bryan did it from the basement of his house in a residential neighborhood for 6 years. I guess he had connections to the right people. The fact that he was caught on videotape having sex with that 15 year-old boy and he was not subject to Megan’s law says a lot about the legal system in PA.



So let’s recap: Bryan was broke he filed Bankruptcy, he filed as a sole proprietor for a video pornography business in Pennsylvania. That business was an illegal operation in that state. He sued his sister for a failed business attempt. And molested a fifteen year-old boy and plead guilty and was not required to register as a sex offender. Looks like 2001 was a banner year for Bryan Kocis. All of these things still do not justify his being killed in the way that he was. It does make you wonder how many people would have a motive to do it though.




Now Joe and Harlow were brought into all of this because of Sean and Grant. They were used as a point of leverage against Bryan. They were used to get a better deal on the settlement that LSG Media was working on with Bryan and Cobra Video. Once all things with Cobra were settled Joe and Harlow were told that they could not work together because of the contract with Cobra Video. Yes that was a dirty deal but I guess that’s how you do business in the porn world. The fact that Sean had broken his contract with Cobra 18 months prior to all of this not withstanding it was a good excuse for Sean and Grant to get rid of Joe and Harlow.


Funny thing is Sean introduced Harlow to Bryan and Falcon Studios. Now from what I have been told Harlow wanted to work with Sean and he went to Cobra Video to do so. Sean was "required" as part of the settlement to film a certain amount of video scenes to fulfill his obligation with regards to the settlement. Harlow wanted to put his image out there with "Brent Corrigan" and when Sean’s obligation was filled with Cobra they could work together at their respective companies and Sean could use the name Brent Corrigan.
Now the settlement forbid Sean to work with any other Cobra models out side of a Cobra production. But Danny Moilin was not a real person and Bryan would have no recourse against him. If Bryan tried to pull the same tricks he pulled with Sean it would be the end of him because he was not diligent with his 2257 records. That could possibly close down Cobra Video. Even if Danny worked as Harlow, Bryan would have no recourse because Harlow was his real name and Bryan could not trademark it and it is a proven fact that Harlow had used that name before.

Now here’s were it gets sticky Robert Wagner was a witness to the age fraud with regards to Sean Lockhart and possible other models. The fact that Sean Lockhart had gone to the FBI on several occasions to report that he was underage when he worked for Cobra Video would have caused Robert some very serious legal problems had the FBI taken Sean’s claims seriously. There is also the question of whether the FBI had Bryan under investigation for producing underage porn. All of this was a good reason for Robert Wagner to be worried. Could this have been a motive for murder???
Now Robert was in effect Bryan’s right hand man and he was diligent in his research of Sean Lockhart. He knew who Harlow was because his picture was on Sean’s deleted Myspace page. That would be where Robert would have seen his picture and put 2+2 together and made the whole plan work. He would vet Harlow to Bryan as Danny and set up the interview and thus set up Harlow for the murder of Bryan Kocis. He would send himself the email with the pictures and send Sean an email saying that Bryan had a new model for him to work with. All of this was done while he was pretending to be Bryan.

Now I have said in a previous post that the coroner could not accurately determine the time of death of Bryan Kocis due to the subsequent fire. That alone could acquit Joe and Harlow and destroy Roberts alibi if serious doubt is placed on the time and date that Bryan died on. I have also said that the subsequent phone calls made to the victim on the supposed date of his murder could have been received anywhere that his cell phone was. I have questioned the location of Bryan’s cell phone and it has been the cause of some interesting emails and online posts on my blog. The fact that anyone could have been on that phone claiming to be Bryan is something to think about. The fact that his phone could have been anywhere is also questionable as well.

His attorney Sean Macias is said to have called him and spoke to him on several occasions on the day Bryan is supposed to have died but he was not present at the preliminary hearing to testify. I find that interesting, is there a reason for that? Maybe he was to easy impeach as a witness because of the dealings between Lee and Bryan of which he was working on. Or the fact that he claimed in the affidavit that the model had arrived when it was in fact another phone call to Bryan that lead him to that assumption. That phone-call from Robert Wagner to Bryan that was placed at 6:30 PM on the night in question. There were also other phone calls placed that were not listed in the affidavit which puts the question out there as to what are they hiding.


I for one when I look at the evidence against Joe and Harlow do not see them as guilty. What I see is the fact that there are certain questions that still need to be answered. Who was the one who advised Harlow to set up the fake email account and get the throwaway phone? Could this be the reason that Harlow panicked and fled the scene did not call the police or the fire department when he saw that Bryan was dead? Because he knew he was being set up? Could that be the reason behind his bravado on the Blacks Beach tapes? They were not sure if it was Sean and Grant who set them up? Maybe who ever killed Bryan set up this elaborate ploy to remove blame from whoever did this and point it towards Sean, Grant, Joe and Harlow.

This is what the trial is for to get to the bottom of this and I am content to wait for the outcome of it and hope that justice is served. Some seem to think that what has been presented so far is conclusive evidence to convict them, lets just hope they are not on the jury. Let’s hope that they do get an impartial jury who will weigh all of the facts in the case and come to a rightful conclusion. Whether they are found innocent or guilty as long as they have a fair trial I will be satisfied that the law took its course. But I for one still do not believe that they did what they are being accused of. I still do believe that you are innocent until proven guilty.

Fag Fridays is moving!







Well it looks like another San Francisco Institution is moving to a new location. Fag Fridays is moving from the legendary Endup at 401 6th street @ Harrison in San Francisco to a new location @2935 16th Street(Between Mission and South Van Ness),San Francisco, Ca.
This Friday October 12th that is the last day there and they will be moving to new digs.
I can tell you this that I remember the Endup fondly from the many years that I went there. I can remember the first time that I went there. It was one of the first bars that I went to when I finally admitted that I was gay. I will tell you this I was terrified and I hid in the back and watched what was going on. I was 21 and really had no clue as to what to expect. But the music helped me overcome my fears and I hit the dance floor. Just like the Trocadaro Transfer I met some lifelong friends who share so many of the same memories. There are so many interesting stories that I could tell you all about the Endup.
This is the same club where Ron Pearson was discovered after a jockstrap dance contest where I was a judge. And if you wanted to know Ron won the contest that night. I being a judge was given free drinks for the night and needless to say I took full advantage of them.

That was also the same night when I almost started my own porn career. Needless I was stopped by a good friend from going that route. I was so drunk that night that a friend drug me out of the club and we chilled in his car till we sobered up enough to go back in the club. take a wild guess where we went after the endup closed, if you said the Trocadaro you would be correct. and wer were back at the Endup sunday moring for "Sunrise Church Services" yes I was a wild child in my youth and I still can be a bit wild to this day. Just a little more responsible thats all.

30th Anniversary party for the Trocadaro Transfer.


The year was 1977 and being gay at that time was just not that cool and I was not even out of the closet yet. But things were changing fast and San Francisco had their first openly gay supervisor. It was also the year that Dan White shot and killed the Mayor, George Moscone and the first gay supervisor, Harvey Milk.

So picture this a scared 18 year-old young man goes to a gay dance club for the first time with 4 of his straight friends. We had just watched "Saturday Night Fever" and disco was the big thing. We heard about this club from a friend from High school. He said it was really fun and the crowd there was outrageous. It was a new club and it was so exclusive you had to be a member or you had to know someone to get in. Our friend told us all about it and said he could get us in if we wanted to go. So we decided to go. This club was in the South of Market area of San Francisco in the warehouse district and there was not much near it but a bunch of Leather bars. The thought of them scared me at the time they are not my thing but I ain’t scured of them anymore.




The club was painted all black and the windows were blacked out it had a black awning in front of it and a line down the block. We were scared to go in but we were also scared that they would not let us in as well. The doorman would look you up and down and he would determine if you were worthy and could get in or not. We watched several people get turned away before we finally got to the door. The doorman, His name was Les, asked for my membership card and I told him I was a guest of a member and he said the member had to be there with us so we could get in. We had been in line for over a hour and we it was getting cold and we were totally freaked out about the whole situation and we were about to turn and bolt from the scene when my friend came out to look for us.




When we finally got in I was amazed the club was huge. There were men in all states of dress and undress woman dancing topless, people in formal attire, fan dancers, Leather Daddies and anything else that you could imagine. The light show was out of this world and in the center of the room was a cluster of mirror balls unlike anything I had ever seen before. The music was loud but not to loud and the sound was clear as a bell. It was just amazing. It was like stepping through a portal and being jettisoned to another planet where you could be who and whatever you wanted to be. We were still scared shitless and my friends I and hung together for dear life. Now what was funny was that all of my friends and I were on the swim team in high school and you might have guessed it, they were all blondes and me being a tall black guy, we garnered a lot of attention that evening. I guess we were all considered twinks at the time but we did not even know what that was at the time. We all got allot of men who wanted to dance with us but we were to scared so we danced with each other. After a few drags from a joint that my friend offered us we chilled out and began to really have fun. We danced all night long and we did not get home until 5am the next morning. Little did we know that we had just gone to the premiere West Cost dance club at the time.






The Trocadaro Transfer was San Francisco’s version of Studio 54. It was a place to dance to the best music of the time with the best dancers on the West Coast. This club was huge, on an average night there would be thousands of dancers there and it would go all night long. Sometimes it would not close until noon on Sunday and when it did we would all run over to the Endup for Sunday church. The Trocadaro Transfer or The Troc as those who were regulars called it was a real fun club to go to if you loved to dance and I loved to dance. So as you may have guessed I became a regular there. I was there from the early days and I was there on the night they closed their doors for the last time 12 years later. Funny thing is the Troc would not die it was the club that other clubs would strive to be like but never quite achieved. It was a place where you could see and meet the latest musical acts performing their latest chart topping hits and dance with the rich and famous. It was a place where it did not matter if you were rich or poor as long as you had fun. In a word the club was magic.




During my tenure there I meet and became great friends with quite a few people and we are still in touch to this day. Some did not make it through the aids crisis but amazingly allot of us did. I guess twirling to the "thumpa thumpa" kept us out of allot of trouble. Well about 5 years ago they decided to have a reunion party for the "Trocodetts", that’s what we were called. And I got an email out of the blue about the upcoming party. I made a few calls to see if it was legit and low and behold it was. So I emailed a friend about it and we decided to go and then we emailed a few others. But what was really amazing is that it started a ground swell of interest and the emails were flying. Soon a friend informed me that they were expecting over a thousand former "Trocodetts" to be at the party




So on the day of the party as we are all arriving at the club it was just a huge hugfest. Oh and yes the party was held in the original building and it was just unreal. It was like a high school reunion but it was fun. I saw people who I had not seen in 10 to 15 years and we all just hugged and laughed about how much fun we had and cried about who was missing. Well that first reunion party was the first of many more and this past Sunday was the latest one. It was the 30th anniversary party of the opening day of The Trocadaro Transfer. What was amazing is that the place was packed and there were a lot of younger gay men there as well as the old stalwarts. The music was classic disco and allot of the songs were re-mixed and refreshed and I as usual was on the dance floor most of the night.







The lights were hot the music was hot and the men were hot. The cute thing was that most everyone was wearing Pearls, the symbol of 30 years. It is really hard to convey what it was like to go to the Troc. The closest thing that I have seen to explain what it was like was the club "Babylon" on Queer as Folk. I must say that I will definitely be at the next party too. I had so much fun at our little alley picnic after the club closed it was hilarious. The best thing is we can all still party all night just like we did 20 years ago. Watching my friends dance to the music and seeing the joy on their faces made me feel so happy I could not even begin to express it to you. To all of the "Trocetts" out there I love you all and you made my night a blast. I will be looking for you at the next party. Happy 30th to all my peeps.

The evidence?

The Blacks Beach tapes are not the slam-dunk evidence that the prosecution claims them to be.
From what we can see, there has been no evidence whatsoever presented of arson in the murder of Bryan Kocis' murder. The robbery charges against Cuadra and Kerekes are based solely on statements allegedly made by Harlow Cuadra on "The Blacks Beach Tapes". Luzerne County prosecutors, from what we can tell, cannot present The Blacks Beach Tape into evidence without triggering a call from Joseph Kerekes to separate his trial from Harlow Cuadra's trial (because, Cuadra, according to The State, incriminates Kerekes on The Blacks Beach Tapes).

Note: Luzerne County did not submit The Blacks Beach Tapes into evidence at the preliminary hearing for Cuadra and Kerekes. And, Luzerne County appeared to do everything in its power to keep the tapes from being put into evidence. From the bitchless blog
The funny thing is that statement makes sense.


Now Jim raises a good point in a comment from H & J go to Trial It is in regards to the email that Sean replied to that was sent him by Bryan, that he was willing to fulfill his contract yet Bryan did not want to do it on Sean’s terms. I find that interesting what did Bryan really want?


What I also find interesting is that Bryan filled the civil suit against Sean and Grant from the Delaware LLC version of Cobra Video which was not even in existence when Sean signed the second contract with Cobra Video in 2005. Also of note the trademarked name “Brent Corrigan” was with the Pennsylvania LLC version of Cobra Video, so in effect Bryan and his attorneys lied to the Federal Courts when they filed that suit.

Sean and Grant were not aware of the two different Cobra Video LLC’s and they fell prey to Bryan’s tactics. There counter suit was thrown out and they had no recourse but to settle as they were in a tough financial situation and to them Bryan held all the cards. Also we have Lee Bergeron who was playing both sides and he was to gain no matter which way things went.

This is another thing that is interesting about this case the deal that Bryan and Lee Bergeron had. Lee was to sell his share of LSG Media to Bryan after the settlement was signed. This is in evidence with the San Diego law enforcement team who were also conducting an investigation in to the murder of Bryan Kocis.
That is why Sean Macias is no longer with his former law office. That “backdoor deal” could have had Macias disbarred for impropriety. Sean and Grant signed the settlement agreement with Cobra Video in good faith but that was not good enough for Lee and Bryan. Lee needed cash and Bryan wanted Sean at any cost.



Sean was key in the federal investigation against Bryan and he could not afford that loose end. Robert Wagner was also a key witness as he was the one who witnessed the ID that Sean presented to Bryan and he stood to do time in prison because of it. This is also the same 2257 record that Bryan presented as evidence in the civil trial. It is one of the only original records of Cobra video still in existence. So Robert had a good reason for the death of Bryan Kocis, he himself did not want to go to prison for child pornography. What could have brought this all on is that Bryan was going to get rid of Robert and Sean. Robert possibly got wind of the plan and took matters in his own hands.


Harlow and Sean wanted to film together and Cobra Video was a way for them to do so. Sean had to do a couple of scenes for Cobra as per the settlement and Harlow figured they could do it on Bryan’s dime. Once the scenes were completed Sean and Harlow could work together and Boybatter could bill Sean as “Brent Corrigan” and all would be well. The only problem was Bryan was murdered and someone used that little bit of info to point the police towards Harlow as the killer.


Robert vetted Harlow to Bryan and he knew who Harlow was as he was the one who helped Bryan spy on Sean. Robert was also at the home of Bryan after he left Las Vegas. Robert was also not pleased with the new settlement agreement and felt that he was being put aside once again for Sean. Robert was also the one who received the pictures of Harlow and he was also the one who told the police about what was missing from the home and he testified to that in his deposition. He is said to have last been in the house on the 21st of January. There are no other witnesses who saw Bryan alive after that date. If a persuasive argument can be made that Bryan Kocis was killed prior to 1/24/07, The Prosecution's Case Against Cuadra and Kerekes IMPLODES.




I have a theory and it is plausible if the police did not get the records of where Bryan's cell phone was when the last calls were made from it. Now what I find interesting is that all of these phone calls were made to Bryan’s cell phone. So in effect Bryan could have been dead for a few days and the calls could have been recieved from anywhere. The police where checking cell tower locations for Harlow and Joe’s phones but did they check where Bryan’s phone was? The instant Message conversation with Cad could have been made from anywhere with an Internet connection and Bryan’s pass word. Melnick the DA said it himself that they were not sure when Bryan died and that he expected more arrests to be made in this case.






The issue here is that the DA’s office and the police were at a roadblock as to who comited the murder of Bryan Kocis. Bryan was running an illegal business from his home and the DA’s office knew about it yet they did nothing to close him down. The federal investigation into child pornography allowed Bryan to stay in business and his prior criminal case was reduced from sexual abuse of children to corruption of minors thus not requiring him to register as a sex offender. This allowed Bryan to continue in his line of business. It also made it easy for the federal investigation into Cobra Video to continue, Bryan was key to that investigation.

With the death of Bryan Kocis there was a major problem at hand. The records of Cobra Video were destroyed and so was much of the video footage along with a lot of the evidence for the federal case. The arson charges will be hard to prove since the Fire Marshall said in the preliminary hearing that no evidence of arson was taken form the crime scene and it has now been razed. The police seem to think they have the murder weapon but the knife that Joe and Harlow purchased was found in their car in Virginia Beach when they were arrested. All of the other evidence is circumstantial and it does not place either Joe or Harlow at the crime scene. There are no witnesses who can ID them at Bryan’s home. And the witness testimony at the preliminary hearing was not conclusive. The Blacks Beach tapes are a double-edged sword for the prosecution as well. That could cause the cases to be spilt up and that would open up another whole can of worms.

What the prosecution is using as fact is that on the Blacks Beach tapes they are claiming that Harlow is being apologetic to Sean and Grant for what has occurred. Although he never confesses to the crime at hand he does refer to it. This was also reiterated in Grants testimony at the preliminary hearing. Harlow also says that the victim felt no pain and that he went fast. But you see when the beach tapes were recorded the first search warrants were issued and with them was a description of the murder scene and how the victim died. So Harlow could have read that and that is where he got his information from.


Who would profit from the destruction of Cobra video? Certainly not Joe and Harlow they had no stake in it. Sean and Grant would not profit from the destruction of Cobra Video, they would possibly gain satisfaction from it but they were still bound by the settlement agreement. Would Lee Bergeron gain from Bryan’s death, he needed Bryan alive to collect on the money he was to be paid from his Share of LSG Media. Although it has been claimed that Lee did receive a six-figure lump sum of money from somewhere, maybe Bryan was a silent investor and he paid Lee for his share of LSG Media. Lee being the principle share holder he would still have control of the profits since Sean and Grant walked away he would not have to give them any of the profits and it would be a win- win for Lee.

I have said from the beginning that this was a convoluted case and there are so many factors involved that we may never know the real truth. One thing for certain is there is one-person dead and two others are on trial for their lives and we are no closer to the truth. This whole case could very well be thrown out on a technicality due to the aborted RICO case from Virginia. The fact that all of their assets were seized and it made it virtually impossible for them to present a good legal defense. We will just have to wait and see about that. The Prosecution put the death penalty on the table in an attempt to get Joe and Harlow to opt out with a plea deal but as of yet it has not worked in the prosecution’s favor. So where does any of this leave us? I for one don’t know what will be proven when this goes to trial but you can truly bet it will be interesting.

What's the deal?







I went Blog slumming today and found an interesting thread on Juicygoo ll or BB’s “A Murder is Annonouced” blog. In this thread BB claims that Robert Wagner never received pictures of Harlow Cuadra/Danny Moilin. This I find quite interesting because the police seem to think that Robert Wagner did receive those pictures and that he was the one who gave those pictures to them. The police say that Bryan sent Robert the pictures on January 22nd 2007 and that Robert was a close and personal associate of Bryan’s. Yet on BB’s blog they are denying this, why is that?

Why the lie about Robert Wagner not recieving the pictures of Harlow? The affidavit clearly states he did. So in affect the police are lying about that fact? Also the affidavit says that Robert was in Bryan's home on the 21st of January. His own words in his statement to the police as to the missing items that the police claim that J&H took.

Well the direct quote is on page 13 of the affidavit in the 3rd paragraph and it clearly says otherwise. Why the lie BB? Also the affidavit says that Robert Wagner was in the home of Bryan Kocis on the 21st of January and that is from the affidavit as well.

In true BB form he goes on to attack anyone that disagrees with his statements. With his childish name calling and wild assumptions to they’re character. As far as BB and his partner in hate “Truth Be Told” go they are constantly attacking the facts of this case and making wild accusations about the posters on his blog. As of this date he has never proven any of his baseless accusations against anyone or proven with facts any of his statements made about those involved.

My favorite was his declaration that Sean Lockhart’s Washington State Drivers license was a fake. He is still stating that Sean is not 20 years old. He was using the fake one that was in Rolling Stone magazine as the real one. A little research would have shown him that the format of that license was wrong but research is not one of BB’s strong suits. When all the documentation shown so far proves otherwise BB and Truth Be told still claim Sean is not 20 years old. Yes BB Sean is 20 he will turn 21 on the 31st of October 2007 so deal with it.

Robert Wagner is involved in the ID fraud with Bryan Kocis as he was a witness to the ID that Sean presented to Bryan for the Cobra videos 2257 records in 2004 This is also the record that Bryan produced in the civil suit documents. Bryan made Robert culpible in the fraud by forcing him to sign the document as a withness. It has also been said that Robert and BB are boyfriends and that they share posting duties on his blog.

What I find a bit troubling is that Sean Macias, Bryan’s attorney says in the affidavit that he was speasking to Bryan on the 24th of January @ “He was engaged in a telephone conversation with the victim @ approximately 18:30 hrs., Macias was conversing with the victim regarding the pending lawsuit as well as several items of issue regarding the members of LSG Media. Macias described the demeanor of the victim at the time as upbeat and “in a real good Mood”. The victim advised Macias that a “New model” was coming over (to the victim’s residence). Macias added that at some point, the victim asked Macias to “hold on”, as the model, who had a name which began with a “D” arrived. Macias could not hear the entire name of the model. This is from page 12 of the police affidavit.

This is where it gets interesting, you see when Bryan said hold on it was not to let a model in, it was to take another phone call. At 16:30 hrs. Robert Wagner called Bryan and Bryan put Macias on hold to take the other call. The model had not yet arrived. Now what I find interesting is that all of these phone calls were made to Bryan’s cell phone. So in effect Bryan could have been dead for a few days and the calls could have been placed from anywhere. The police where checking cell tower locations for Harlow and Joe’s phones but did they check where Bryan’s phone was?

Could it have been somewhere else possibly New York? Maybe Robert had Bryan’s Cell phone and he was accepting the calls and impersonating Bryan. That would explain the phone call at 18:30 hrs. As it would give him an alibi for that time period. Did the police check the cell tower location of Roberts phone call to Bryan? The instant Message conversation with Cad could have been made from anywhere with an Internet connection and Bryan’s pass word. Robert also states that Bryan’s laptop computer was missing, maybe he had it along with Bryan’s cell phone.

Melnick the DA said it himself that they were not sure when Bryan died and that he expected more arrests to be made in this case. Was he talking about Robert Wagner? It was revealed by the San Diego investigation that Lee Bergeron and Bryan Kocis had a deal for Lee to sell his portion of LSG Media to Bryan. This information was culled from the electronic communications of Bryan Kocis. Sean Macias left his law firm shortly after the settlement due this fact. Also Robert Wagner left his job at a New York Law firm due to his unethical behavior.

Robert had an ongoing relationship with Bryan and he was well vetted by Bryan. Funny thing he is now he is denying this. Robert knew who Harlow was and he may have perpertrated the fraud that he was Bryan to Harlow. Harlow did not arrive at Bryan’s house until after 8:00pm and he said that Bryan’s was the door was opened and he looked in and saw Bryan was dead and he heard someone upstairs and smelled smoke and he panicked and left.

This was around 8:20 pm as to witness testimony. The fire department was called and the fire was put out in less than 20 minutes. This is from testimony from the preliminary hearing. I find this whole case to be quite convoluted and the evidence is circumstantial at best but people have been convicted with less. I just want justice and I hope we do get it. If it is proven that Joe and Harlow did this crime so be it but I will not convict them on this blog. I still say that all are innocent until proven guilty in a court of law. Let the trial begin.
